Overtime Regulations are Back in the News

As we have previously reported, the Department of Labor has initiated a Request for Information (RFI) as the first step toward a formal new rulemaking on the “white collar exemption” from overtime payment under the Fair Labor Standards Act (FLSA).   

ISSA has joined ranks with our colleagues in the Partnership to Protect Workplace Opportunity (PPWO) in submitting a comment letter in response to the RFI.  To view the letter, go to:  www.issa.com/PPWO.

Members may recall that the courts recently struck down the overtime regulations issued by the Obama Administration’s Department of Labor.  Those regulations would have more than doubled the salary threshold that helps define who is eligible for overtime pay.

We do not as yet know when a formal new overtime rulemaking will begin, but we plan to again join PPWO in filing comments.

We greatly appreciated all the feedback ISSA members provided as we went through the previous overtime rule-making, which ultimately was declared invalid by the courts.  ISSA will continue to monitor and comment on this rulemaking as appropriate, and will keep members informed as the process moves forward.
