The U.S. Environmental Protection Agency (EPA) regulates disinfectants, sanitizers, and related cleaning products, and requires that pesticide manufacturers register their products with the agency as “antimicrobial pesticides.” Individual states also require the registration of pesticide products when pesticides are sold in those states. This is a requirement for both manufacturers and distributors of all pesticides, including antimicrobial products such as disinfectants, sanitizers, and germicides. However, states implement vastly different regulations, covering fees—which are usually flat and per product, renewal deadlines, and penalties.

These regulations change frequently, and for one company to closely monitor every state’s agricultural department would be challenging. To ease this regulatory burden, ISSA provides the State Pesticide Registration Survey on an annual basis as a benefit to our members. Each year, we compile this document with updated listings of all pesticide registration fees, renewal dates, penalties for selling unregistered pesticides, and state registration authority references. Many pesticide manufacturers now sell their products in more states than they previously did due to the COVID-19 pandemic, so having access to the most up-to-date regulatory information is more important than ever. Accordingly, ISSA’s 2020 Pesticide Registration Survey is now available. You can access the full survey by becoming an ISSA member.

Since our June 2019 update, five states have changed their registration fees, one state has changed its renewal deadline, and 12 states have changed their enforcement actions for registration violations. Further, many states continue to increase their enforcement actions for registration violations, and state registration authority references have been updated for eight states. Stiff penalties, including substantial fines and prison, remain a reality. In fact, ISSA was told by a number of state representatives that pesticide registration enforcement will continue to be a high priority in 2020-2021.
