New York’s Ingredient Disclosure Program Compliance DelayedJanuary 18, 2019
On January 9, the New York State Department of Environmental Conservation announced it has delayed the deadline for manufacturers to comply with the “Household Cleansing Product Information Disclosure Program.” The program requires manufacturers of cleaning products sold in New York to disclose chemical ingredients and other information on their websites.
This policy as designed is incredibly problematic for manufacturers and, as a result, is currently being challenged in a lawsuit by the American Cleaning Institute (ACI) and the Household and Commercial Products Association (HCPA).
Despite the use of the term “household,” the New York disclosure program applies to commercial and institutional cleaning products as well as their consumer counterparts. ISSA will continue to follow the lawsuit, provide ongoing guidance on compliance, and provide updates on compliance deadlines for members moving forward. ISSA’s Government Affairs Department will be monitoring and proactively advocating on behalf of our members’ interests in states that consider implementing similar programs in the future.
California. California enacted legislation in October 2017 that requires website ingredient disclosure for cleaning products sold in the state by January 1, 2020; and product label disclosure of ingredients by January 1, 2021.
