New York Delay’s Ingredient Disclosure Program Again

On June 12, the New York State Department of Environmental Conservation announced it had delayed the enforcement deadline for manufacturers to comply with the “Household Cleansing Product Information Disclosure Program” to January 2, 2020. This is the second delay announced by New York as the original deadline was July 1, 2019. The program requires manufacturers of cleaning products sold in New York to disclose chemical ingredients and other information on their websites.
One of the reasons for the delay is that the program is currently being challenged in a lawsuit by the American Cleaning Institute (ACI) and the Household and Commercial Products Association (HCPA). The reason for the lawsuit is the policy as designed is incredibly problematic for manufacturers to comply with.
Despite the use of the term “household,” the New York disclosure program applies to commercial and institutional cleaning products as well as their consumer counterparts. ISSA will continue give our members ongoing guidance on compliance and updates on compliance deadlines for members moving forward.
ISSA supports consistent disclosure laws that help to educate the public while protecting the legitimate interests of business. Cleaning is critical to protecting public health and therefore any proposals not relying on sound science do a disservice to the public. ISSA Advocacy will continue to monitor and proactively advocate on behalf of our members’ interests as states and the federal government consider implementing similar programs in the future.
California. California enacted legislation in October 2017 that requires website ingredient disclosure for cleaning products sold in the state by January 1, 2020; and product label disclosure of ingredients by January 1, 2021.
Additional Information. As a benefit to our members, ISSA has produced a summary of the program ahead of the compliance deadlines for California and New York.
Upcoming Events On The Topic. On October 9, ISSA will be hosting a webinar where you can learn the latest information about the federal and state regulation requiring ingredient disclosure for cleaning products.
On November 18, just prior to the ISSA Show North America we are teaming up with the Household Consumer Products Association (HCPA) to put on a day long workshop in Las Vegas. Registration for this event is separate.
