Warning: MoCRA Deadlines Ahead!
December 29, 2023, is fast approaching and marks the effective date for several major MoCRA requirements—most notably facility registration and cosmetic-product listing.

The Modernization of Cosmetics Regulation Act of 2022 (MoCRA) added Section 607 of the Federal Food, Drug and Cosmetic Act that requires:

  1. Facilities that manufacture or process cosmetic products for U.S. distribution to register the facility with the U.S. Food and Drug Administration (FDA); and 
  2. “Responsible Persons” (i.e., manufacturer or distributor whose name appears on the product) to list cosmetic products and ingredients with the FDA.

Note: The definition of “cosmetic products” includes products such as body and hand washes, as well as cleansing wipes intended for use on the body or parts thereof.

Draft Guidance – In anticipation of the impending December 29 deadline, the FDA recently issued draft guidance for industry titled Registration and Listing of Cosmetic Product Facilities and Products (“Draft Guidance”). ISSA prepared a summary based on the Draft Guidance to assist ISSA members subject to MoCRA in meeting their new facility registration and product-listing obligations. Learn more

Input Requested: Proposed DOL Expansion of Overtime Eligibility
On August 30, the U.S. Department of Labor (DOL) announced a proposed rule change to overtime pay regulations under the Fair Labor Standards Act. The proposal aims to modify the criteria for the executive, administrative, and professional exemption from overtime pay eligibility. Current regulations exempt employees from receiving overtime pay if they have a salary of US$35,568 per year or above. DOL proposes raising that threshold to $60,209 per year, marking a nearly 70% increase. The proposal also includes automatic increases to this threshold every three years, regardless of economic conditions at the time. ISSA plans to submit comments on the proposal to DOL. CA Governor Prevents PFAS Prohibitions
Last week, California Governor Gavin Newsom vetoed three pieces of legislation that sought to ban per- and polyfluoroalkyl substances (PFAS)-containing cleaning products, menstrual goods, and artificial turf in the state. Learn more

CA Governor Signs Law Requiring Big Businesses to Disclose Emissions
Large businesses in California will have to disclose a wide range of emissions under a new law that Governor Gavin Newsom signed—the most sweeping mandate of its kind in the nation, AP reported. Learn more

WA Minimum Wage to Increase
Washington State’s minimum wage will increase to US$16.28 an hour in January, up 54 cents from the current rate, according to The Columbian. The Washington Department of Labor and Industries calculates the minimum wage for the coming year based on federal estimates of price increases. The 3.37% increase reflects rising costs of housing, food, medical care, and other expenses as shown in the Consumer Price Index. Learn more
